We have the talent and resources to do what it takes to get you justice.
What Is Medical Device Product Liability Law?
Product Liability law provides compensation for physical injuries resulting from defective and unreasonably dangerous products, as well as from the failure of a manufacturer or seller to warn the consumer of product dangers. The manufacturer may have even recalled the product due to risk to the consumer.
If you have been injured or affected by a defective medical product, Fieger Law is here for you. Because the nature of medical devices are that they are necessary for health (not just a luxury), medical device manufacturers must be held to far higher standard.

Talc Ovarian Cancer
Talc powder has long been commonly used by women for hygiene purposes. Unfortunately, research has shown a link between talc and ovarian cancer. Talc is a natural mineral containing fine particles that can travel up to the ovaries. It has been shown to increases the risk of ovarian cancer from 2% to 33%.
Johnson & Johnson, the manufacturer of Baby Powder and Shower-to-Shower, has known about the dangers of talcum powder for more than 40 years, yet failed to warn customers and continued to promote it for hygienic use.
A class action suit is pending against Johnson & Johnson, but many women are filing separate lawsuits to cover damages that are not provided for under the class action suit. If you have been diagnosed with ovarian cancer and you have a history of using talc powder, you may be eligible for damages.
An inferior vena cava filter, or IVC filter, is a small cone-shaped device implanted in the largest vein in the body, located just below the kidneys. The device is designed to trap an embolism that may form in the legs, preventing the blood clot from reaching the heart and lungs.
These devices are intended to be removed after about two months. Unfortunately, they are often left in much longer, which can lead to serious complications. They can tear veins or organs, migrate to other areas of the body or break.
Defective Hip/ Joint Replacements
If you received a hip implant or other joint replacement and are experiencing complications, you may be able to sue the manufacturer for damages. Metal-on-metal hip replacements, manufactured by companies including Stryker, DePuy and Wright, as well as /Zimmer Persona knee replacements may cause an array of complications, including:
- Joint loosening or dislocation
- Wear and/or corrosion possibly leading to osteolysis or bone dissolution
- Excessive metal debris leading to metal ion generation
- Inflammation of tissues leading to complications and pain
- Hypersensitivity or allergic response
- Broken devices
- Adverse local tissue reaction
Birth Control Medication & Implants
The use of certain birth control devices is linked to pseudotumor cerebri, a condition of intracranial hypertension resulting in migraines, tinnitus (ringing in the ears), blurred vision, permanent vision loss, vertigo, and optic nerve swelling.
The birth control devices linked to pseudotumor cerebri are:
- Depo – Sub Q Provera 104
- Nuva Ring
- Ortho Ring
Manufactured by Bayer Pharmaceuticals, this permanent birth control device is implanted in the fallopian tubes, where scar tissue forms around its coils and prevents sperm from reaching the eggs.
To date, tens of thousands of women have filed complaints that the device has caused them physical and emotional pain. They cite side effects ranging from menstrual problems and fatigue, to headaches and chronic permanent pain throughout the abdomen. Many complain of a combination of symptoms.
Transvaginal Mesh & Hernia Mesh Failure
This surgical mesh, made of plastic, was used extensively to treat women with pelvic organ prolapse and stress urinary incontinence, conditions which often result from a hysterectomy, menopause, and childbirth.
Far from being helpful, tens of thousands of women have been hurt by the device. The design of the mesh, and the way it is implanted through the vagina, can lead to complications such as infection, erosion, and organ perforation.
A power morcellator is a device used during hysterectomies and other gynecological surgeries. It grinds away cysts and growths, but is sometimes accidentally used on cancerous growths. The FDA has warned that this medical device can spread cancer cells in the abdominal cavities of women, taking a cancer from Stage 1 to Stage 4 in a single procedure.
If you or someone you love was diagnosed with cancer after a surgeon used a power morcellator during a hysterectomy, to remove uterine fibroids, or in another gynecological procedure, Fieger Law can help you seek the justice you deserve.
Many of these cancers are deadly, rare and aggressive — such as leiomyosarcoma — leading to recalls and banning of several models of this device.
E-Cigarette Fire and Explosion Injury
The fuel cells of e-cigarettes have been known to explode, causing severe chemical and combustion burns. If this has happened to you, litigation is currently being prepared against manufacturers. Call us to hear your story and find out if you’re entitled to compensation.
If you had a knee or hip infection following joint surgery, the cause may have been the Bair Hugger surgical blanket. This blanket is linked to increased rates of infection, as it uses forced airflow in order to keep patients warm during surgery. The air current displaces contaminants in the operating room, causing them to land on your joint implants or in your open joint.
Just for Men Hair Dye Side Effects
Linked to blistering, cellulitis, facial swelling, painful chemical burns, scarring, seeping facial sores, severe itching and skin rash.
Medtronic Insulin Pump
These devices have been linked to the detachment of the cap, which results in an improper amount of insulin being dispensed. Effects include hypoglycemia, hyperglycemia, loss of consciousness, and/or death.
