MICHIGAN BIRTH INJURY LAWYERS

The birth of a child is supposed to be a joyous occasion. But when medical staff makes negligent mistakes, the birth can turn tragic in an instant.

Newborns are fragile and require delicate care not just from their mothers, but also from the team that’s helping to deliver them.
Countless innocent babies are harmed in our state every year because of excessive force used during delivery, delayed C-sections, and failure to monitor their heartbeats and oxygen levels.

This is unacceptable, and their families deserve full and fair compensation for the injuries and complications they suffer.

Proving a healthcare provider caused your child’s injury can be difficult, as some birth injuries may not show symptoms until months or years later when parents notice developmental delays.

At Fieger Law, we’ve helped many families whose lives were forever changed by mistakes made before, during, and immediately after the birth of their children. We aren’t afraid to stand up against some of the biggest hospitals and insurers in the area if it means getting our clients the justice they deserve.

WHAT ARE COMMON BIRTH INJURIES?

Some of the most common and devastating birth injuries include:

Cerebral palsy is a disability caused by abnormal development of or damage to an infant’s brain. In some cases, babies may be born with this condition. Other times, it’s the result of head trauma or loss of oxygen during delivery.

Symptoms Include:

  • Overly stiff or floppy limbs
  • Delays in major milestones like lifting their head, rolling over, sitting up, and crawling
  • Involuntary tremors or movements
  • Difficulty with fine motor skills, like grasping
  • objects
  • Difficulty eating or excessive drooling

Erb’s palsy is a birth injury caused by nerve damage to a baby’s arm or shoulder that can occur during delivery. It results in weakness of the arm, and in serious cases, paralysis of the limb.

  • Poor grip strength
  • No startle or Moro reflex
  • Abnormal positioning of the arm \Lack of movement of the arm

OTHER BIRTH INJURY CASES WE HANDLE

Contact Us

Birth injuries can take many forms and may result from delayed treatment, improper delivery techniques, medication errors, or failure to monitor the mother and baby during labor. All birth injury types, especially when they’re caused by negligence, deserve experienced legal representation.

In addition to the birth injuries listed above, our firm handles cases involving:

Hypoxic-Ischemic Encephalopathy (HIE)

HIE is a serious brain injury caused by reduced oxygen and blood flow to a baby’s brain during labor or delivery and can lead to permanent developmental disabilities.

Shoulder dystocia occurs when a baby’s shoulder becomes trapped during delivery, increasing the risk of nerve damage, fractures, and oxygen deprivation injuries.

Shoulder Dystocia Injuries

Improper use of forceps, vacuum extractors, or excessive force during delivery can cause skull fractures, bleeding in the brain, and other traumatic head injuries.

Skull Fractures and Head Trauma

Excessive pulling, twisting, or pressure during childbirth can damage a baby’s spinal cord and result in partial or permanent paralysis.

Spinal Cord Injuries

Pressure on a baby’s face during a difficult delivery or misuse of delivery instruments can damage facial nerves and cause weakness or paralysis.

Facial Nerve Injuries

Failure to diagnose or properly treat infections during pregnancy or labor can expose a baby to serious complications, including brain damage, sepsis, and long-term developmental problems.

STEPS WE TAKE WHEN BUILDING A BIRTH INJURY CASE

Birth injury cases require extensive investigation, medical analysis, and careful documentation. At Fieger Law, our legal team takes the following steps to build the strongest possible claim on behalf of your family:

Consulting Medical Experts:

We work with qualified medical experts to determine whether doctors, nurses, or hospitals failed to meet the accepted standard of care and how that failure caused your child’s injuries.

2

Reviewing Medical Records:

We examine prenatal records, labor and delivery notes, fetal monitoring strips, imaging results, and postnatal care records to identify signs of negligence or medical errors.

1

Calculating Long-Term Damages:

We assess the full financial impact of the injury, including future medical treatment, therapy, assistive devices, in-home care, educational support, and lost earning potential.

3

Negotiating With Insurance Companies:

We prepare a detailed demand package and negotiate aggressively with the healthcare provider’s insurance company for a full and fair settlement.

4

Filing a Lawsuit if Necessary:

If the insurance company refuses to offer reasonable compensation, we are prepared to file a lawsuit and pursue your case through litigation.

5

Representing Your Family at Trial:

Our attorneys are prepared to present evidence, question expert witnesses, and advocate for your family in court when a trial becomes necessary.

6

Recovering and Distributing Compensation:

Once a settlement or verdict is secured, we work to resolve outstanding medical liens and ensure compensation is distributed to your family as efficiently as possible.
