When patients enter a hospital, they place their trust in institutions intended for healing and protection. That trust was shattered at DMC Sinai-Grace Hospital, where Wilfredo Figueroa-Berrios, an alleged serial sexual predator, was allowed to work as a nurse.
Fieger Law, alongside Flood Law, is standing with survivors and demanding accountability by filing lawsuits against DMC Sinai-Grace Hospital, its parent company Tenet Health, and Wilfredo Figueroa-Berrios.
Neglectful Hiring: A Preventable Tragedy
Perhaps most alarming is that these devastating assaults could easily have been prevented. “A simple background check would have revealed these incidents,” said James Harrington, Managing Partner at Fieger Law, during a press conference announcing the lawsuits.
Neglectful hiring—when an institution fails to conduct proper screening and background checks—allows dangerous individuals into positions of trust and authority. DMC Sinai-Grace Hospital and its parent company Tenet Health had a responsibility to thoroughly vet healthcare workers.
They failed.
A Pattern of Predatory Behavior
Deeply disturbing complaints made by co-workers and patients against Berrios, a nurse working at hospitals in Southeast Michigan. Information about these complaints were available to those who hired him, but were ignored:
- Figueroa-Berrios previously worked at Trinity Health Livonia Hospital, where he is alleged to have committed assaults against patients.
- There are at least seven additional known victims, with possibly hundreds of patients affected.
- On August 12, Figueroa-Berrios allegedly sexually assaulted a 31-year-old woman while she was admitted as a patient at Sinai Grace.
The investigation so far has revealed that these weren’t isolated incidents. This alleged serial sexual predator operated within multiple healthcare systems for over a decade. Various hospitals and nursing agencies in Michigan hired him and put him in contact with vulnerable patients, not just in Detroit.
Fieger Law: Fighting for Survivors
Our lawsuits against DMC Sinai-Grace Hospital, Tenet Health, and Figueroa-Berrios are about demanding accountability and preventing future abuse. “We will provide answers, and we will secure justice for everyone involved,” Harrington emphasized.
Attorney Todd Flood, working with Fieger Law on these cases, framed the mission clearly: “This is a joint force to help survivors come forward against a predator and against an institution that allowed that predator to work in its confines.”
Your Voice Matters
Sexual assault in healthcare settings represents one of the most profound violations of trust imaginable. Patients in hospitals are often at their most vulnerable—ill, injured, sedated, or unconscious. They trust hospitals and their employees to help them when in need, with the utmost dignity and integrity.
“Their voice matters, their voice is important, and their voice needs to be heard,” Harrington stated during the press conference.
If you or someone you love has been affected by Wilfredo Figueroa-Berrios or has experienced sexual assault in a healthcare setting, you are not alone.
